Terms of Service
Welcome to DashDuel. These Terms of Service ("Terms") are a binding agreement between you and DashDuel ("we," "us," or "our") and govern your use of the DashDuel mobile application and related services (the "App"). By creating a profile or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old to use DashDuel. By using the App, you represent and warrant that you are 18 or older and legally able to enter into these Terms. DashDuel is not directed to, and may not be used by, anyone under 18.
2. What DashDuel Is
DashDuel is a social fitness game. You connect Apple Health, and your real step count is used to compete against friends in head to head duels, group battles, and step tournaments. Outcomes are determined by physical activity (steps), which is a measure of effort and skill, not chance.
3. Virtual Items Only (No Real Money Value)
Gems and points are virtual items. They have no monetary value, cannot be exchanged or redeemed for cash or any real world goods, and cannot be withdrawn, transferred off the platform, or sold.
Gems may be purchased with real money through the App Store and are used only to enter tournaments and to unlock in app features such as taunts and cosmetics. Points are awarded within the App for activity and competition results and are used only inside the App. Entry "stakes," "payouts," and "prizes" refer exclusively to these virtual items. You are not wagering real money, and you cannot win real money or anything of monetary value. DashDuel is a game of skill using a virtual economy; it is not gambling and offers no real money prizes.
4. Purchases
In app purchases of gems are processed by Apple under the App Store terms. All purchases are final and non refundable except as required by law or Apple's policies. Prices may change. Virtual items are licensed to you for personal, non transferable use within the App and may be modified or discontinued at any time.
5. Fair Play and Conduct
You agree not to: (a) falsify, spoof, or manipulate step or activity data, or use any device or method to generate steps you did not take; (b) use bots, automation, or multiple accounts to gain an advantage; (c) harass, threaten, or abuse other users; (d) post unlawful, hateful, or infringing content; or (e) interfere with or attempt to breach the security of the App. We may remove content, restrict features, or terminate accounts that violate these rules.
6. Health and Safety
DashDuel is not a medical or fitness advisory service and does not provide medical advice. Always exercise within your ability, be aware of your surroundings, and consult a physician before beginning any new activity. You are solely responsible for your safety while being active.
7. Accounts
An anonymous account is created for you when you choose a username. You are responsible for activity on your account. You may delete your account at any time from within the App, which removes your profile and associated data as described in our Privacy Policy.
8. Intellectual Property
The App, including its design, software, logos, and content, is owned by us and protected by law. We grant you a limited, revocable, non exclusive license to use the App for personal, non commercial purposes. You retain rights to content you submit but grant us a license to use it to operate the App.
9. Disclaimers
The App is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error free, or accurate, including step or distance data provided by Apple Health or your device.
10. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the prior twelve months or twenty five US dollars.
11. Termination
We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may stop using the App and delete your account at any time.
12. Changes
We may update these Terms from time to time. Material changes will be reflected by updating the date above. Continued use of the App after changes means you accept the updated Terms.
